Terms & Conditions

Last Updated: October 19, 2026

These Terms and Conditions govern access to and use of the 1805LOADED website, its content, products, and services. By accessing or using this website, you agree to comply with these Terms and Conditions. If you do not agree, you should discontinue use of the website.

1. About 1805LOADED

1805LOADED provides website design and development, WordPress development, custom plugins and themes, and related digital solutions. References to 1805LOADED in these terms include the brand and the person or legal entity responsible for providing the relevant service, as applicable.

2. Acceptable Use

You must use this website lawfully and responsibly. You must not:

  • Attempt to gain unauthorized access to the website, its hosting environment, accounts, or associated systems.
  • Interfere with website security, availability, or normal operation.
  • Upload or distribute malicious code, fraudulent content, or unlawful material.
  • Misuse contact forms, impersonate another person, or submit misleading information.
  • Copy, exploit, or use website content in a way that infringes intellectual property rights or applicable law.

We may restrict or suspend access where reasonably necessary to protect the website, its users, or our legitimate interests, subject to applicable law.

3. Intellectual Property

Unless otherwise stated, original content published on this website, including text, branding, graphics, designs, and original code, is owned by 1805LOADED or used with permission from the relevant rights holder.

You may view this content for personal and informational purposes. You must not reproduce, redistribute, modify, sell, sublicense, or commercially exploit protected material without the required permission, except where permitted by law.

Third-party trademarks, software, libraries, and other materials remain the property of their respective owners and may be subject to separate licence terms.

Ownership, transfer of rights, permitted use, and licensing of work created for a client will be determined by the applicable written agreement and any relevant third-party licence. Payment for a project does not, by itself, transfer rights beyond those expressly agreed or provided by law.

4. Services and Project Agreements

Descriptions of our services, portfolio projects, plugins, themes, and digital products are provided for informational purposes. Features, availability, specifications, and pricing may change.

Before undertaking a paid project, the relevant parties should agree on the scope of work, deliverables, fees, payment schedule, timeline, revision limits, maintenance, support, and applicable ownership or licensing arrangements.

Any quotation, accepted proposal, order, product licence, or signed agreement applicable to a particular engagement forms part of the terms governing that engagement. Where terms conflict, the specific written agreement will prevail to the extent permitted by law.

We do not guarantee a particular commercial result, search engine ranking, traffic level, revenue, or business outcome unless a specific commitment is expressly agreed in writing.

5. Payments, Cancellations, and Refunds

Prices, deposits, payment milestones, recurring charges, renewal conditions, cancellation procedures, and refund eligibility must be stated in the applicable quotation, checkout terms, product licence, or written agreement.

Unless otherwise agreed in writing, work may be scheduled to begin after the required initial payment has been received. Delays in providing agreed materials, approvals, access credentials, or other client requirements may affect delivery timelines.

Any cancellation or refund request will be assessed under the applicable agreement and relevant law, taking into account work completed, costs properly incurred, and any applicable consumer protections. No provision of these terms removes a right to a refund or remedy that cannot lawfully be excluded.

6. Client Responsibilities

Clients are responsible for providing accurate project information, obtaining necessary rights and permissions for materials they supply, reviewing deliverables, and maintaining appropriate backups and access controls for systems under their control.

Clients must not request or use our services to infringe third-party rights, distribute unlawful content, commit fraud, or violate applicable law.

Unless expressly included in the agreed scope, ongoing maintenance, hosting, domain renewals, third-party subscription fees, security monitoring, content updates, and support after delivery are not automatically included in a project fee.

7. Third-Party Software and Services

Our work may depend on third-party software, hosting providers, APIs, payment processors, plugins, themes, or external platforms. Their availability, pricing, functionality, and policies are controlled by their respective providers.

We are not responsible for independent changes, interruptions, discontinuation, or policy decisions made by third-party providers. Where a third-party issue affects an agreed project, the parties will address its impact in accordance with the applicable agreement and law.

8. Website Information and Availability

We make reasonable efforts to keep website information accurate and the website operational. However, we do not guarantee that all content will always be complete, current, uninterrupted, or free from errors.

Information on this website is general information about our work and services. It should not be treated as a substitute for a specific written proposal, product licence, or professional advice appropriate to your circumstances.

9. Limitation of Liability

To the extent permitted by applicable law, 1805LOADED shall not be liable for indirect or consequential losses arising from the use of, or inability to use, this website.

For paid services, any applicable limitations of liability must be assessed alongside the relevant project agreement, the nature of the claim, and applicable law. Nothing in these terms excludes or limits liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or limited.

Nothing in these terms removes statutory rights, remedies, or protections that apply to a customer or other user under applicable law.

10. Indemnity

To the extent permitted by law, you may be responsible for losses, claims, or reasonable costs arising directly from your unlawful use of the website, your infringement of another party’s rights, or your material breach of these terms. This does not make you responsible for losses caused by our own unlawful conduct or other liability that cannot legally be transferred to you.

11. Privacy and Personal Information

Personal information submitted through the website will be handled in accordance with the applicable Privacy Policy and relevant data protection law.

You should avoid submitting passwords, payment card details, or other highly sensitive information through general contact forms or unsecured communication channels.

12. Suspension and Termination

We may restrict access to the website where reasonably necessary to address security risks, unlawful activity, or a material breach of these terms. Any termination of a paid service or client engagement will also be subject to the applicable agreement and law.

13. Changes to These Terms

We may update these Terms and Conditions to reflect changes to our services, business practices, or legal obligations. The updated version will be published on this page with a revised date.

Changes will apply from the date they become effective, subject to any notice, consent, or other requirements imposed by law. Changes will not automatically override an existing written agreement where doing so would be legally ineffective.

14. Governing Law and Disputes

These Terms and Conditions are intended to be governed by the applicable laws of the Federal Republic of Nigeria, subject to any mandatory legal protections that apply to a particular transaction or user.

The parties should first make reasonable efforts to resolve disputes through good-faith communication. Where a dispute cannot be resolved informally, it may be referred to a court with competent jurisdiction under applicable law.

15. Severability and Entire Agreement

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These terms govern general use of the website. They do not replace a separate written agreement, quotation, order, or licence that specifically governs a project or product.
